Terms of Service

Activity Record is a journal, not care. It is for educational and personal wellness purposes only. It does not provide medical, psychological, or clinical advice, and no one reads what you write in it.

These terms cover the app on iPhone and iPad, the app on Android, this website, and the practice worksheet.

1. What this covers

These terms are an agreement between you and Everyday Insight LLC (“we”, “us”). They cover the Activity Record app for iPhone and iPad, the Activity Record app for Android, the website at activityrecordapp.com, and the practice worksheet on that site. We’ll call all of it “Activity Record”.

Two other documents sit alongside these terms and are part of your agreement with us: the app privacy policy and the website privacy policy.

2. Agreeing to these terms

By using Activity Record you agree to these terms. If you don’t agree, please don’t use it.

If you’re using an app, you’ll be asked to agree before you start. You can read these terms again at any time from Settings, or on this page.

3. Who can use Activity Record

You need to be at least 13 years old. If you’re under 18, you need permission from a parent or guardian.

Activity Record is not intended for children under 13, and we ask that they don’t use it. The app collects nothing from anyone, so it collects nothing from children either — but the age limit still applies.

4. What Activity Record is, and what it isn’t

Activity Record is a journal. You note what you were doing in an hour and rate how it went, and over time the app shows you patterns in what you wrote down. That’s the whole of it.

Activity Record is provided for educational and personal wellness purposes only. Nothing in the app, on this website, or in anything they produce constitutes medical, psychological, clinical, or other professional advice. No diagnosis, assessment, or treatment is provided, and Activity Record is not a medical device. Using Activity Record does not create a therapist and client, provider and patient, or any other professional or therapeutic relationship with Everyday Insight LLC or any person. It is not a substitute for care from a qualified professional.

If you have concerns about your mental or physical health, please consult a qualified professional. If you may be in crisis, contact your local emergency services or a crisis line right away.

5. Nobody is reading what you write

Activity Record is not an emergency service, a crisis service, or a monitoring service. Nothing you write is transmitted to us, reviewed by us, or seen by any person other than you. We cannot see what you record, so we cannot notice distress in it, cannot respond to it, and will not act on it. No one is on the other end.

Never use Activity Record to seek help in an emergency. If you are in danger or thinking about harming yourself, contact your local emergency services or a crisis line immediately.

6. Decisions you make are your own

You are solely responsible for any decision you make and any action you take based on what Activity Record shows you.

In particular, do not use Activity Record to make decisions about medication, treatment, or medical or psychological care. Those decisions belong with a qualified professional who knows your situation. Bringing your record to an appointment as something to talk about is a reasonable thing to do; treating a pattern in it as a clinical finding is not.

7. What the observations are, and aren’t

The patterns Activity Record shows you are plain descriptions of numbers you entered yourself. They are produced by simple arithmetic against fixed thresholds, on however much or little you happened to log.

They are not findings, predictions, diagnoses, or advice, and they are not clinically validated. They can be wrong, misleading, or an artefact of a thin or unrepresentative stretch of data. A pattern is a starting point for your own reflection, nothing more. You should not rely on them, and we make no promise that they are accurate, meaningful, or useful to you.

8. Reminders are best effort

If you turn on reminders, they’re scheduled through your device’s own notification system. We can’t guarantee any reminder will arrive, or arrive on time. Phones delay or suppress notifications for all sorts of reasons — battery saving, focus modes, permissions, restarts, timezone changes. Don’t rely on Activity Record for anything where a missed or late reminder would matter.

9. What you record stays yours

Everything you write in Activity Record belongs to you. We don’t ask for a licence to it, and we’re not in a position to use it in any way: your record is held on your own device, and if you turn on sync, in your own private storage with Apple or Google. We have no servers that receive it and no way to read it. This is described in full in the privacy policies.

Because we never hold your record, we can’t recover it for you, and we have nothing to hand over or delete on your behalf.

10. Keeping your own copies

Your record is your responsibility to preserve. Activity Record can export your data as a PDF, a spreadsheet file, or a full backup file, and we’d encourage you to use that from time to time.

You could lose what you’ve recorded — by deleting the app, losing or replacing your device, clearing your browser data, or turning off sync. The browser worksheet is more fragile still: some browsers clear it automatically after a period without a visit. We are not responsible for lost entries, and we have no copy to restore.

Files you export are for your own personal use. They are generated on your device from what you typed, and they are not certified, verified, or official records of anything.

11. Sync, and the app stores

Sync through iCloud or Google Drive is optional and off unless you turn it on. When you use it, you’re also using Apple’s or Google’s service, under their terms and their privacy policy, with your own account. The same goes for downloading the apps from the App Store or Google Play.

We don’t control those services. If one of them changes, stops working, or loses data, that’s between you and them.

Activity Record is free and there’s very little to ask of you. Please don’t:

14. What belongs to us

The Activity Record name, the app, the website, and their design, text, and code are the property of Everyday Insight LLC, except for third-party components credited where they appear. You may use Activity Record for your own personal use, and print or export your own record freely. Nothing here gives you rights to our brand or our code.

15. Activity Record is provided as it is

We provide Activity Record “as is” and “as available”, without warranties of any kind, whether express or implied. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We don’t promise that Activity Record will be uninterrupted, available at any particular time, free of errors, or that it will produce any particular result for you. It’s a journal, and what you get out of it depends on what you put in.

Some places don’t allow these exclusions, in which case they may not apply to you.

16. Limits on our liability

To the fullest extent permitted by law, Everyday Insight LLC will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any lost data or lost entries, arising from your use of Activity Record. This includes any harm said to arise from a decision you made based on something Activity Record showed you, and from any reminder that did not arrive.

Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us for Activity Record — which is nothing — or twenty-five US dollars.

Some places don’t allow these limits, in which case they may not apply to you.

17. If someone brings a claim because of you

If your use of Activity Record, or your breach of these terms, causes someone to bring a claim against us, you agree to defend us, cover our reasonable costs including legal fees, and hold us harmless. We’ll tell you promptly if that happens and let you handle the defence, and we won’t settle anything that puts an obligation on you without asking you first.

18. Time limit on claims

Any claim arising out of Activity Record or these terms must be brought within one year of when it arose. After that it’s permanently barred, unless the law where you live doesn’t allow that limit.

19. Changes

We may update Activity Record, change how it works, or stop offering part of it. We may also update these terms. If we make a significant change to the terms, we’ll ask you to agree again the next time you open the app, and we’ll update the version and date at the top of this page.

Carrying on using Activity Record after a change means you accept the updated terms. If you don’t accept them, stop using it and delete the app.

20. Stopping

You can stop at any time. Delete the app and your record on that device goes with it. If you had sync on, you can remove the stored copy through your Apple or Google account settings.

There’s no account to close, because there was never one to open.

21. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in California, and you and we agree to that jurisdiction.

Nothing here takes away consumer rights you have under the law of the place you live that cannot be waived by agreement.

22. The rest

If any part of these terms is found unenforceable, the rest stays in force. If we don’t enforce something straight away, that isn’t a waiver of it.

Sections 4 through 10, and 14 through 18, survive after you stop using Activity Record.

These terms, together with the privacy policies, are the whole agreement between you and us about Activity Record.

Registro de Actividades es un diario, no atención médica. Es solo para fines educativos y de bienestar personal. No brinda asesoramiento médico, psicológico ni clínico, y nadie lee lo que escribes en él.

Estos términos cubren la app para iPhone y iPad, la app para Android, este sitio web y la hoja de práctica.

1. Qué cubre esto

Estos términos son un acuerdo entre tú y Everyday Insight LLC (“nosotros”). Cubren la app Registro de Actividades para iPhone y iPad, la app para Android, el sitio web activityrecordapp.com y la hoja de práctica de ese sitio. A todo eso lo llamaremos “Registro de Actividades”.

Otros dos documentos acompañan estos términos y forman parte de tu acuerdo con nosotros: la política de privacidad de la app y la política de privacidad del sitio web.

2. Aceptar estos términos

Al usar Registro de Actividades aceptas estos términos. Si no estás de acuerdo, por favor no lo uses.

Si usas una de las apps, se te pedirá que aceptes antes de empezar. Puedes volver a leer estos términos cuando quieras desde Ajustes o en esta página.

3. Quién puede usarlo

Necesitas tener al menos 13 años. Si eres menor de 18, necesitas permiso de tu madre, padre o tutor.

Registro de Actividades no está dirigido a menores de 13 años y les pedimos que no lo usen. La app no recopila nada de nadie, así que tampoco recopila nada de menores, pero el límite de edad sigue aplicando.

4. Qué es Registro de Actividades y qué no es

Registro de Actividades es un diario. Anotas qué estabas haciendo en una hora y calificas cómo te fue, y con el tiempo la app te muestra patrones en lo que anotaste. Eso es todo.

Registro de Actividades se ofrece solo para fines educativos y de bienestar personal. Nada en la app, en este sitio web ni en lo que produzcan constituye asesoramiento médico, psicológico, clínico ni de ningún otro tipo profesional. No se brinda diagnóstico, evaluación ni tratamiento, y Registro de Actividades no es un dispositivo médico. Usarlo no crea una relación de terapeuta y cliente, de profesional y paciente, ni ninguna otra relación profesional o terapéutica con Everyday Insight LLC ni con ninguna persona. No sustituye la atención de un profesional calificado.

Si tienes preocupaciones sobre tu salud mental o física, consulta a un profesional calificado. Si puedes estar en crisis, comunícate de inmediato con los servicios de emergencia de tu zona o con una línea de crisis.

5. Nadie está leyendo lo que escribes

Registro de Actividades no es un servicio de emergencia, de crisis ni de monitoreo. Nada de lo que escribes se nos transmite, ni lo revisamos, ni lo ve ninguna persona más que tú. No podemos ver lo que registras, así que no podemos notar señales de angustia, no podemos responder y no actuaremos al respecto. No hay nadie del otro lado.

Nunca uses Registro de Actividades para pedir ayuda en una emergencia. Si estás en peligro o piensas en hacerte daño, comunícate de inmediato con los servicios de emergencia de tu zona o con una línea de crisis.

6. Las decisiones que tomes son tuyas

Eres la única persona responsable de cualquier decisión que tomes y de cualquier acción que realices con base en lo que Registro de Actividades te muestre.

En particular, no uses Registro de Actividades para tomar decisiones sobre medicamentos, tratamientos ni atención médica o psicológica. Esas decisiones corresponden a un profesional calificado que conozca tu situación. Llevar tu registro a una cita como algo de qué conversar es razonable; tratar un patrón como un hallazgo clínico no lo es.

7. Qué son y qué no son las observaciones

Los patrones que Registro de Actividades te muestra son descripciones simples de números que tú misma o tú mismo ingresaste. Se generan con aritmética sencilla y umbrales fijos, sobre la cantidad de horas que hayas registrado, sea mucha o poca.

No son hallazgos, predicciones, diagnósticos ni consejos, y no están validados clínicamente. Pueden estar equivocados, ser engañosos o ser producto de un periodo escaso o poco representativo. Un patrón es un punto de partida para tu propia reflexión, nada más. No deberías depender de ellos, y no prometemos que sean precisos, significativos ni útiles para ti.

8. Los recordatorios son mejor esfuerzo

Si activas los recordatorios, se programan mediante el sistema de notificaciones de tu propio dispositivo. No podemos garantizar que un recordatorio llegue, ni que llegue a tiempo. Los teléfonos retrasan o silencian notificaciones por muchas razones: ahorro de batería, modos de concentración, permisos, reinicios, cambios de zona horaria. No dependas de Registro de Actividades para nada en lo que un recordatorio tardío o perdido importe.

9. Lo que registras es tuyo

Todo lo que escribes en Registro de Actividades te pertenece. No pedimos ninguna licencia sobre ello y no estamos en posición de usarlo de ninguna manera: tu registro se guarda en tu propio dispositivo y, si activas la sincronización, en tu propio almacenamiento privado con Apple o Google. No tenemos servidores que lo reciban ni forma de leerlo. Esto se describe por completo en las políticas de privacidad.

Como nunca tenemos tu registro, no podemos recuperarlo por ti, y no tenemos nada que entregarte ni que borrar en tu nombre.

10. Guardar tus propias copias

Conservar tu registro es tu responsabilidad. Registro de Actividades puede exportar tus datos como PDF, como archivo de hoja de cálculo o como archivo de respaldo completo, y te recomendamos usarlo de vez en cuando.

Podrías perder lo que registraste: al borrar la app, al perder o cambiar de dispositivo, al borrar los datos del navegador o al desactivar la sincronización. La hoja en el navegador es aún más frágil: algunos navegadores la borran automáticamente tras un tiempo sin visitas. No somos responsables de las entradas perdidas y no tenemos ninguna copia que restaurar.

Los archivos que exportas son para tu uso personal. Se generan en tu dispositivo a partir de lo que escribiste, y no son registros certificados, verificados ni oficiales de nada.

11. Sincronización y las tiendas de apps

La sincronización con iCloud o Google Drive es opcional y está desactivada salvo que tú la actives. Cuando la usas, también estás usando el servicio de Apple o de Google, bajo sus términos y su política de privacidad, con tu propia cuenta. Lo mismo aplica al descargar las apps desde App Store o Google Play.

No controlamos esos servicios. Si alguno cambia, deja de funcionar o pierde datos, eso es entre tú y ellos.

12. Si obtuviste la app en App Store

Estas disposiciones aplican a la app para iPhone y iPad, y Apple las exige:

14. Lo que nos pertenece

El nombre Registro de Actividades, las apps, el sitio web y su diseño, texto y código son propiedad de Everyday Insight LLC, salvo los componentes de terceros acreditados donde aparecen. Puedes usar Registro de Actividades para tu uso personal e imprimir o exportar tu propio registro libremente. Nada aquí te da derechos sobre nuestra marca ni nuestro código.

15. Se ofrece tal como está

Ofrecemos Registro de Actividades “tal cual” y “según disponibilidad”, sin garantías de ningún tipo, expresas ni implícitas. En la máxima medida permitida por la ley, rechazamos todas las garantías implícitas, incluidas las de comerciabilidad, idoneidad para un fin determinado y no infracción.

No prometemos que Registro de Actividades funcione sin interrupciones, esté disponible en algún momento determinado, esté libre de errores, ni que produzca algún resultado en particular para ti. Es un diario, y lo que obtengas depende de lo que pongas en él.

Algunos lugares no permiten estas exclusiones; en ese caso, puede que no apliquen para ti.

16. Límites de nuestra responsabilidad

En la máxima medida permitida por la ley, Everyday Insight LLC no será responsable de daños indirectos, incidentales, especiales, consecuentes ni ejemplares, ni de datos o entradas perdidas, derivados de tu uso de Registro de Actividades. Esto incluye cualquier daño que se atribuya a una decisión que hayas tomado con base en algo que Registro de Actividades te mostró, y a cualquier recordatorio que no haya llegado.

Donde la responsabilidad no pueda excluirse, nuestra responsabilidad total hacia ti se limita a la cantidad que nos hayas pagado por Registro de Actividades — que es nada — o veinticinco dólares estadounidenses, lo que sea mayor.

Algunos lugares no permiten estos límites; en ese caso, puede que no apliquen para ti.

17. Si alguien presenta una reclamación por tu causa

Si tu uso de Registro de Actividades, o tu incumplimiento de estos términos, hace que alguien presente una reclamación contra nosotros, aceptas defendernos, cubrir nuestros costos razonables incluidos los honorarios legales, y mantenernos indemnes. Te avisaremos pronto si eso ocurre y te dejaremos llevar la defensa, y no aceptaremos ningún acuerdo que te imponga obligaciones sin consultarte antes.

18. Plazo para presentar reclamaciones

Cualquier reclamación derivada de Registro de Actividades o de estos términos debe presentarse dentro del año siguiente a su origen. Después de ese plazo queda excluida de forma permanente, salvo que la ley del lugar donde vives no permita ese límite.

19. Cambios

Podemos actualizar Registro de Actividades, cambiar cómo funciona o dejar de ofrecer alguna parte. También podemos actualizar estos términos. Si hacemos un cambio importante, te pediremos que los aceptes de nuevo la próxima vez que abras la app, y actualizaremos la versión y la fecha al inicio de esta página.

Seguir usando Registro de Actividades después de un cambio significa que aceptas los términos actualizados. Si no los aceptas, deja de usarlo y borra la app.

20. Dejar de usarlo

Puedes dejar de usarlo cuando quieras. Al borrar la app, tu registro en ese dispositivo se va con ella. Si tenías la sincronización activada, puedes eliminar la copia guardada desde los ajustes de tu cuenta de Apple o de Google.

No hay ninguna cuenta que cerrar, porque nunca hubo una que abrir.

21. Ley aplicable

Estos términos se rigen por las leyes del Estado de California, sin considerar sus normas sobre conflicto de leyes. Cualquier disputa se presentará ante los tribunales estatales o federales ubicados en California, y tú y nosotros aceptamos esa jurisdicción.

Nada aquí elimina los derechos de consumidor que tengas bajo la ley del lugar donde vives y que no puedan renunciarse por acuerdo.

22. Lo demás

Si alguna parte de estos términos resulta inaplicable, el resto sigue vigente. Si no hacemos valer algo de inmediato, eso no significa que renunciemos a ello.

Las secciones 4 a 10 y 14 a 18 siguen vigentes después de que dejes de usar Registro de Actividades.

Estos términos, junto con las políticas de privacidad, constituyen el acuerdo completo entre tú y nosotros sobre Registro de Actividades.
